FERRE operates this shop and this website, including all information, content, features, tools, products and related services to provide you, as a customer, with a personalized shopping experience (collectively, the “Services”). FERRE is a store powered by Shopify, which enables us to provide the Services to you.

Your order is not accepted until FERRE has confirmed its acceptance. We must receive and process your payment before your order is accepted. Please carefully review your order before submitting it, as FERRE may not be able to honor requests for cancellation after an order is accepted. If we decline, modify, or cancel an order, we will attempt to notify you by contacting the email address, billing address and/or phone number provided at the time the order was made.
Your purchases may be returned or exchanged only in accordance with our Refund Policy [LINK].
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

SECTION 5 – SHIPPING AND DELIVERY
We are not responsible for shipping or delivery delays. All shipping timelines are estimates and are not guaranteed. We are not responsible for delays caused by freight carriers, customs processing, or events beyond our control. Once we transfer the products to the carrier, title and risk of loss pass to you.

FERRE is powered by Shopify, which enables us to provide the Services to you. However, the sales and purchases you make in our Store are made directly with FERRE. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and FERRE, including any injury, damage or loss arising from the products and services purchased. You hereby expressly release Shopify and its affiliates from any claims, damages and liabilities arising out of or related to your purchases and transactions with FERRE.

You agree to indemnify, defend and hold harmless FERRE, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from and against any losses, damages, liabilities or claims, including reasonable attorneys’ fees, made by any third party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.
We will notify you of any claim subject to indemnification, provided that failure to promptly notify you will not relieve you of your obligations, except to the extent that you are materially prejudiced by such failure. We may control the defense and settlement of such claim at your expense, including the choice of counsel, but we will not settle any claim that requires non-monetary obligations from you without your consent (which shall not be unreasonably withheld). You will cooperate with us in the defense of indemnified claims, including by providing relevant documents.
