Terms of sale

Voici la traduction en anglais, rédigée dans un style clair, professionnel et conforme aux usages juridiques anglo-saxons pour des Conditions Générales de Vente :

Preamble

These general terms and conditions of sale apply exclusively to current and future commercial relations concluded between:

FOXIS SAS, owner of the website https://www.foxis.fr, whose registered office is located at 73 rue Victor Hugo, 92400 Courbevoie (France), registered with the Nanterre Trade and Companies Register under number B 879 878 262, hereinafter referred to as "the seller," "FOXIS," or "We,"

and:

Any natural or legal person making a purchase via the Foxis.fr website, hereinafter referred to as "the buyer," "the client," or "You." Any condition that does not comply with these general terms and conditions and that You may have proposed will be rejected unless We have explicitly agreed to its applicability in writing.

Pricing / Products

Some products require the purchaser to be of legal age. When purchasing such products, you must certify that you are over 18 years old and accept the following general terms and conditions of sale. Furthermore, the buyer assumes full responsibility for the use of the purchased products.

Prices are indicated in Euros, all taxes included. The items We sell are described and presented with the utmost accuracy. The photos, texts, information, or characteristics of the products shown in the catalogue are not contractual.

Despite all our precautions, errors may occur; We cannot be held liable for such errors.
Except in cases of warranty, any transaction between FOXIS and its clients that is not contested within 3 weeks cannot give rise to a claim.

Product and price offers are valid as long as they appear on the Foxis.fr website and are subject to availability. If a product becomes unavailable after the order has been placed, the customer will be notified by email, phone, or letter. The seller will offer a replacement with a similar product. If the customer refuses, the order will be cancelled; if payment has already been processed, the customer will be refunded within a maximum of 30 days.

Delivery Method

Your order will be delivered to the address you provided when placing your order.
Shipping costs will be automatically calculated and updated based on the delivery method, the item, and the delivery location selected in your cart.

For destinations outside Europe, customs duties or import taxes are due once the parcel reaches its destination country. You will then be responsible for any additional customs clearance charges. As the seller has no control over these taxes, We cannot predict their amount. For more information and precise rates, please contact your local customs office.

The delivery times indicated are average times observed with recognized carriers such as La Poste and GLS. We cannot be held responsible for any delay caused by the carrier. These timeframes begin once your order has been processed by our logistics department. Any in-stock order placed and paid for before 12 p.m. is processed and shipped the same day.
In accordance with the Châtel Law, we inform you that the maximum delivery time is 30 days after receipt of your payment.

Transport Information

Delivery is carried out by our carriers within the delivery zones covered by FOXIS. Delivery consists of handing the product directly to the intended recipient or, if absent, to another person authorized by the client. For availability reasons, an order may be delivered in multiple shipments at no additional cost.

If the client wishes delivery to two different locations, two orders must be placed.
The following events are considered force majeure and release the seller from its delivery obligations: war, riots, fire, strikes, adverse weather, accidents, supply shortages, and any other natural disaster.

Transfer of Ownership

Ownership of the goods is transferred to the client only after full payment. In the case of deferred payment, Foxis.fr retains ownership of the goods until full payment, even if insolvency proceedings are initiated against the client, in accordance with Articles L.621-122 et seq.

Delivery Conditions

For standard delivery, bulky parcels are not delivered upstairs but at the front door of the house or building.

The delivery times indicated are average estimates. Delays cannot give rise to compensation, penalties, or cancellation. However, if the product has not been delivered after the maximum delivery date (except in cases of force majeure), the client may cancel the sale within 60 days by sending a registered letter. The seller will then refund the client, excluding any other compensation.

The seller reserves the right to cancel an order if delivery is deemed too difficult for the carrier.

In case of absence, a delivery notice will be left with instructions to arrange a new delivery. Delivery is considered completed on the first attempted delivery date.

Upon delivery, the client must verify the condition of the products. In case of visible damage, the client may accept or refuse the goods. In all cases, anomalies must be noted on the carrier’s delivery slip and confirmed within three business days by registered letter, with a copy sent to Foxis.fr (73 rue Victor Hugo, 92400 Courbevoie, France).

If an anomaly is detected, an anomaly report must be filled out. If the products were accepted, the client may contact us to arrange a return under the “Satisfied or refunded” section below. If refused, the client must request the return of the goods to the seller.

Satisfied or Refunded

If you changed your mind within 14 days of your purchase

The legal withdrawal period is 14 days from the delivery date. Once your return is accepted, your refund will be processed within 14 days after receipt of the returned product (plus banking delays of 3 to 7 days).

An email will be sent once your return is processed. For exchanges or refunds, the client must return the item at their own expense, in its original packaging, unused, and complete with accessories, manuals, documentation, and the invoice. The first step is to contact us beforehand by email (contact@foxis.fr) or phone to obtain return authorization and the return address.

Any item returned without prior contact will be automatically refused.

If the item is returned incomplete or damaged, a depreciation fee may apply based on the SAV assessment.

In case of withdrawal, we will refund your order or exchange defective or non-conforming products. Refunds will be made according to the original payment method, once the SAV diagnosis is completed.

Warranty

The client benefits from the legal warranty against hidden defects (art. 1625 et seq. of the French Civil Code).
The warranty does not cover:

  • Failure to follow maintenance instructions

  • Handling errors or lack of maintenance

  • Misuse, including professional or communal use

  • Any external cause

Warranty activation requires contacting the brand’s consumer service. The buyer may also contact us at contact@foxis.fr or by phone (+33 1 48 11 33 25). The original packaging and the purchase invoice must be kept.
